Ailenin Korunmasına Dair Kanun’a Göre Hakimin Verebileceği Önlemler
Ailenin Korunmasına Dair Kanun hükümlerine göre aile mahkemesi yargıcından bu yasada sayılan önlemlerin alınmasını isteyebilirsiniz. Bu önlemler şöyledir:
Kusurlu eşin veya diğer aile bireyinin;
a) Aile bireylerine karşı şiddete veya korkuya yönelik söz ve davranışlarda bulunmaması,
b) Müşterek evden uzaklaştırılarak bu evin diğer aile bireylerine tahsisi ile bu bireylerin
birlikte ya da ayrı oturmakta olduğu eve veya işyerlerine yaklaşmaması,
c) Aile bireylerinin eşyalarına zarar vermemesi,
ç) Aile bireylerini iletişim araçları ile rahatsız etmemesi,
d) Varsa silah veya benzeri araçlarını genel kolluk kuvvetlerine teslim etmesi,
e) Alkollü veya uyuşturucu herhangi bir madde kullanılmış olarak şiddet mağdurunun yaşamakta olduğu konuta veya işyerine gelmemesi veya bu yerlerde bu maddeleri kullanmaması,
f) Bir sağlık kuruluşuna muayene veya tedavi için başvurması.
Bu önlemlerin uygulama süresi 6 ayı geçmez ve eğer eş önlemlere uyulmazsa hapis cezasıyla cezalandırılır.
Kendiniz ve çocuklarınız için Türk Medeni Kanunu’na göre birlikte yaşarken katkı nafakası ödemesi için dava açabilirsiniz. Ayrı yaşarken ise boşanma davası açmasanız dahi yapacağı parasal katkının belirlenmesini isteyebilirsiniz. Ayrıca yasaya göre ortak yaşama nedeniyle kişiliğiniz, aile huzurunuz tehlikede olduğu için ayrı yaşama hakkına sahipsiniz. Ayrı yaşama hakkına sahip olduğunuz için parasal katkı yanında ortak konutun sizin ve çocuklarınızın barınmasına özgülenmesini de isteyebilirsiniz, böylece eşinizi evden uzaklaştırabilirsiniz.
Ortak konut tapu kütüğünde eşinizin adına kayıtlı ise ortak konutunuzun başkasına devrini engellemek için yine aile mahkemesi yargıcına başvurarak aile konutu olarak özgülenmesine ilişkin karar vermesini isteyebilirsiniz. Verilen kararın tapu sicil müdürlüğünden sicile işlenmesini isterseniz eşiniz sizin rızanız olmadan başkasına devredemez.
